Isle of Anglesey County Council terms and conditions for mooring users
Mooring licenses are allocated subject to the following terms and conditions.
- All applications for a mooring / berthing shall be made on the official council mooring agreement / mooring license form and must give sufficient information on the name, size and type of boat.
- Mooring / berthing are let and charged on a yearly basis which commences on either 1 April, annually or the date of agreement, if later, and expires on 31 March of the following year.
- Sticker/s shall be clearly displayed on the boat / vessel at all times. The sticker/s will be issued by the council only after payment has been received.
- The applicant shall at all times comply with the byelaws or other directions being in force, a copy of which can be inspected at the Harbourmasters Office, Amlwch, and/or online.
- The applicant shall at all times and in all respect comply with the safety regulations and harbour orders that are in force, and which pertain to the size of vessel in the harbour during the period in which the vessel is moored.
- The applicant accepts and confirms that the mooring / berthing license that is offered is solely for the vessel named on the agreement form.
- The applicant shall not transfer or sub-let the mooring / berthing at any point.
- The maximum size of vessel that will be allocated a berth in the inner harbour is 11 meters length and only where appropriate.
- The applicant shall not in any way alter the position of the mooring/berth without the prior written permission of the harbour master.
- The applicant shall accept full responsibility for the proper mooring / berth of the vessel. The applicant is responsible for providing proper and suitable equipment that secures the vessel to the mooring / berth. The owner shall notify the Harbourmaster in writing of any damage to any property / boats/vessels and shall indemnify Isle of Anglesey County Council from, and against, all claims, loss, demands, or other expenses arising from such damage.
- If any maintenance work has been undertaken on the mooring / berth, please inform the Harbourmaster of the work that has been done. The Harbourmaster may take periodic inspections of unmaintained moorings / berths.
- The council will consider refunding mooring / berthing fees if the mooring agreement is terminated by the applicant and only if the circumstances for terminating the agreement could not be foreseen and that the circumstance for terminating the agreement was beyond the control of the applicant.
- Isle of Anglesey County Council accepts no liability whatsoever for the death or injury caused to any person, or damage to any property of the applicant or his invitees, agents or employees, or any other persons except where such act involved negligence on the part of Isle of Anglesey County Council or agent.
- The vessel operator must take all steps to ensure the safety of their vessel and crew whilst operating within the harbour.
- The applicant shall take-out third-party insurance cover with an insurance company of repute to a sum of a minimum of £3,000,000 and particulars of each policy shall be provided with each agreement or on request to cover the duration of the agreement/license.
- When a berth holder permanently vacates a berth, he/she will be responsible for the removal of the associated mooring and ground tackle associated with the berth of the departed vessel.
- Due to demand for moorings, Berthing is offered for vessels that are in use. Should a vessel lay at its berth for 12 months and not be used without good reason. The vessel will be requested to vacate with the mooring not being offered the following year and will pass to the next applicant on the waiting list.
- by signing this mooring agreement, you undertake to maintain your vessel detailed in this agreement in a fully seaworthy condition at all times and ensure an insurance policy always remains in date while the vessel is in the water as defined in section 14 of this agreement. Should either of these terms be found to be not maintained you agree to Isle of Anglesey County Council removing your vessel by the most appropriate and economical means and placed at a storage facility with all associated costs of this process becoming recoverable from the owner / person named on this agreement.
- If a vessel is thought to be unseaworthy, the owner will be requested to provide a current survey report carried out by a registered surveyor. If the owner disagrees with the decision that a craft is unseaworthy, an independent approved surveyor will be used to determine this.
- If after 1 calendar month any issues relating to the seaworthiness of a vessel have not been rectified or if the vessel presents an imminent danger, it will be removed immediately with all costs associated with this being passed on to the registered owner.
- All moorings to be inspected annually, with proof of inspection available upon request.
On acceptance of the offer of the agreement, mooring holder must pay the annual fee in accordance with the current schedule of maritime fees and charges.
Commercially registered vessels can operate and berth in accordance with their insurance policy.
All private small craft berthing is between 1 April to 31 October and should vacate the inner and outer harbour between November 1 to March 31, unless by prior approval and production of a valid insurance covering the November 1 to March 31.
